Terms & Conditions — “Results First” Model

1. Results-First Engagement

We operate on a results-first basis.

Clients are not required to pay the full service fee upfront. Instead, the first 30 days are used to demonstrate performance and results.

Following this initial period, continuation is based on client satisfaction and results achieved.

2. Performance Expectation

While results vary by business, our systems are designed to generate £10,000+ in new revenue within the first 30 days on average.

This is not a guaranteed figure, but a performance benchmark based on previous client results.

3. What Counts as Revenue

Revenue includes all income generated directly from our campaigns, systems, and automation, including:

  • New customer or member sign-ups
  • Paid trials, challenges, or front-end offers
  • Upsells or service upgrades
  • Deposits and confirmed bookings

4. Revenue Attribution

Revenue will be attributed to our systems where leads, bookings, or sales originate from:

  • Paid advertising campaigns
  • Funnels or landing pages we build
  • CRM automations (SMS, email, reactivation campaigns)

5. Advertising Spend

Advertising spend is separate from our service and is paid directly by the client to the relevant advertising platform (e.g. Meta, Google).

We do not cover, reimburse, or guarantee results based on ad spend levels.

6. Client Responsibilities

To ensure results, the client agrees to:

  • Respond to leads promptly where required
  • Honour all offers and pricing presented in campaigns
  • Provide access to required systems, accounts, and data
  • Maintain operational capacity to fulfil incoming demand

Failure to meet these responsibilities may impact results.

7. Access & Onboarding Requirements

The client agrees to provide all required access (including ad accounts, Facebook page, Meta Business Suite, CRM systems, domains, and communication platforms) in a timely manner.

Delays in providing access may delay campaign launch and performance timelines.

8. Campaign Start Date

The 30-day performance period begins once:

  • Campaigns are live
  • Funnels and systems are fully operational
  • Tracking is correctly set up
  • Client is using the system to a satisfactory level

9. Lead Quality Disclaimer

We are responsible for generating leads and opportunities.

Conversion of those leads into paying customers depends on the client’s sales process, follow-up, and internal operations. As such, we do not guarantee conversion rates.

10. No Control Over External Factors

We are not responsible for factors outside of our control, including but not limited to:

  • Sales performance
  • Pricing or offer competitiveness
  • Market conditions
  • Internal staffing or operations

11. Continuation & Payment

At the end of the initial 30-day period:

  • If the client is satisfied with results, the agreement continues at the full service fee
  • If the client chooses not to continue, no ongoing obligation is required

12. Early Termination During Trial

If the client chooses to cancel before the end of the initial 30-day period:

  • The client agrees to cover all incurred costs associated with setup, software usage, and campaign deployment
  • These costs will be invoiced and must be settled in full

 

Early termination voids any results-based expectations.

13. Intellectual Property

All systems, funnels, automations, and marketing assets created remain the property of DigiSurf Agency LLC unless otherwise agreed in writing. The client agrees not to replicate, copy, or distribute our systems, funnels, or processes without written permission.

14. Right to Verify Performance

We reserve the right to verify performance and revenue through CRM systems, booking platforms, or other relevant data sources such as POS systems and payment platforms.
